Please read these terms carefully before using Animalty. These terms govern your use of our application and services.

These Terms and Conditions ("Terms") govern your access to and use of the Animalty mobile application and related services (the "App" or "Service"). By downloading, creating an account, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Provider Information
The Service is provided by Vladislav Palekhov, acting as an individual entrepreneur registered in Georgia ("Developer", "we", "us", "our").

2. Availability, Territories, and Sanctions
2.1. The App is intended for users in the European Union, the United Kingdom, the United States, and other territories where the App is made available through app stores.
2.2. The App may be restricted or unavailable in certain countries/regions due to export controls, sanctions, app store limitations, or legal/compliance requirements. We may update restrictions at any time.
3. Eligibility and Age
3.1. Not directed to children. The App is not designed for children and does not contain child-oriented content.
3.2. Minimum age: You must be at least 16 years old to create an account and use the Service (or older if required by local law).
3.3. Marketplace & bookings: To offer services, book services, or otherwise use Marketplace features (if available), you must be 18+.
Note: App Store age rating (e.g., "4+") is a content rating and does not override these eligibility rules.
4. Definitions
"Account": your registered profile in the App.
"Pet Profile": information you enter about a pet (e.g., age, weight, vaccines, medications).
"User Content": any content you submit (photos, messages, reviews, listings, etc.).
"Marketplace": features that allow users to list, find, book, and communicate about pet services (walking, sitting, training, etc.).
"Provider": a user who offers services through the Marketplace.
"Booking": a reservation/request for an offline service.
"AI Output": recommendations or content generated automatically (training, nutrition, activity, health-related insights).
"Subscription": paid plan for premium features.
"Third-Party Services": external services integrated into the App.
5. Account Registration and Security
5.1. You must provide accurate information (including email and name) and keep it updated.
5.2. You are responsible for all activity under your Account and for keeping your login credentials secure.
5.3. Notify us immediately if you suspect unauthorized access.
6. What the Service Provides
6.1. The App provides tools and content for pet care and training, such as:
- reminders (vaccines, medications, routines),
- health tracking (weight, symptoms, tests, meds),
- walking maps and route tracking,
- educational content and tips,
- AI-based recommendations,
- Marketplace features (public profiles, chat, bookings, ratings/reviews) if available.
6.2. We may change, suspend, or discontinue parts of the Service at any time.
7. IMPORTANT: No Veterinary or Professional Advice
7.1. The Service is provided for informational and organizational purposes only.
7.2. The App does not provide veterinary, medical, behavioral diagnosis, emergency assistance, or professional advice.
7.3. If your pet is sick, injured, distressed, or aggressive, seek help from a qualified veterinarian or professional trainer immediately.
8. AI Output Disclaimer
8.1. AI Output may be incorrect, incomplete, or not appropriate for your pet.
8.2. You are responsible for verifying AI Output before acting on it (especially health, activity, diet, training intensity, or medication-related information).
8.3. We do not guarantee outcomes (health improvements, training results, or behavioral changes).
9. Pet Owner Responsibility
9.1. You are solely responsible for your pet's welfare and for decisions you make based on the App.
9.2. You confirm you are the pet's owner or have authorization to act on behalf of the owner.
9.3. You must follow applicable laws and safety rules (leash/muzzle rules, vaccinations, public conduct, etc.).
10. Marketplace Terms (Platform Only — No Liability for Offline Services) If Available
10.1. The Marketplace is a platform to help users find and coordinate offline services (walking, sitting, training, etc.).
10.2. We are not the provider of offline services. Providers are independent third parties, not employees, agents, or contractors of the Developer.
10.3. Any agreement for offline services is between the user and the Provider.
10.4. We do not guarantee Provider identity, licensing, quality, suitability, availability, or outcomes.
10.5. Disputes related to offline services should be addressed between the user and the Provider. We may provide reasonable assistance (e.g., account review, moderation, access to logs as permitted by law).
11. Subscriptions, Trials, and Payments (App Store / Google Play)
11.1. If you purchase a Subscription or other in-app purchase via Apple App Store or Google Play Store, billing is handled by the respective store and subject to their terms and policies.
11.2. Auto-renewal: Subscriptions renew automatically unless cancelled before renewal through the relevant store settings.
11.3. Trial: A 2-day trial may be offered and converts to a paid Subscription unless cancelled before it ends (as shown in the store checkout flow).
11.4. Refunds: Refunds for store purchases are handled under the store's policies and process.
11.5. Prices are shown in the App and/or the relevant store checkout flow. Taxes may apply depending on your location and the nature of the purchase.
12. User Content (Chat, Reviews, Listings) and License
12.1. You keep ownership of your User Content.
12.2. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content only as necessary to operate, secure, and improve the Service (e.g., showing your profile/listing if applicable, delivering messages, displaying reviews).
12.3. You are responsible for your User Content and confirm you have the rights to post it.
12.4. We may remove or restrict User Content that violates these Terms or applicable law.
13. Prohibited Conduct
You must not:
- post illegal, harmful, abusive, or infringing content;
- engage in fraud, impersonation, or manipulation of reviews/ratings;
- use the App to promote harm to animals or facilitate cruelty;
- attempt to bypass security, scrape data, reverse engineer, or disrupt the Service;
- use the Service for illegal services or unsafe activity.
14. Moderation and EU Digital Services Act (DSA) — Notice & Action
14.1. Report illegal content: Email support@animalty.com with:
- where the content appears (screenshots/links),
- why you believe it is illegal,
- your contact information.
14.2. We may remove or restrict content and/or accounts where required by law or these Terms.
14.3. You may appeal moderation decisions by contacting support@animalty.com. Where required by law, we may provide additional information about the reasons for our decision.
15. Privacy, GDPR, and Data Retention
15.1. Our processing of personal data is described in our Privacy Policy: [link-to-privacy-policy].
15.2. Controller: Vladislav Palekhov (IE 345714453) is the data controller for GDPR purposes, unless stated otherwise in the Privacy Policy.
15.3. We process personal data under lawful bases such as contract performance, legitimate interests, consent (where required), and legal obligations (details in the Privacy Policy).
15.4. Account deletion & retention: If you delete your account, we retain certain data for up to 6 months after deletion for security, fraud prevention, dispute handling, and legal compliance, unless a longer retention is required by law or a shorter period applies under applicable mandatory law (details should match the Privacy Policy).
15.5. Hosting: Our infrastructure is hosted in Amazon Web Services in an EU region (as further described in the Privacy Policy).
16. Third-Party Services
The App may use Third-Party Services including:
- Firebase / Amplitude (analytics),
- Sentry (crash/error reporting),
- push notifications via platform services,
- maps via Google Maps / Mapbox,
- AI services via OpenAI.
Your use of Third-Party Services may be governed by their own terms/policies. We are not responsible for third-party outages or changes.
17. Intellectual Property
The App (excluding User Content) and all related IP rights are owned by us or licensed to us. You receive a personal, limited, revocable, non-transferable license to use the App for personal, non-commercial purposes under these Terms.
18. Disclaimers
18.1. The App is provided "as is" and "as available."
18.2. We do not guarantee uninterrupted availability, error-free operation, or specific outcomes from training/health tracking features.
19. Limitation of Liability
19.1. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits/data/goodwill.
19.2. We are not liable for harm or losses arising from:
- reliance on informational content or AI Output,
- your decisions/actions regarding your pet,
- offline services provided by third-party Providers (if Marketplace is available),
- disputes between users and Providers,
- Third-Party Services.
19.3. Where liability cannot be excluded under mandatory EU consumer law, we limit liability to the minimum extent permitted.
20. Indemnity
You agree to indemnify and hold us harmless from claims and expenses arising from your breach of these Terms, your User Content, your misuse of the App, or your interactions with other users/Providers.
21. Support and Communications
21.1. Support is provided via email at support@animalty.com.
21.2. Our target response time is within 72 hours, but this is not a guarantee and may vary due to volume, holidays, or incident response needs.
21.3. We may send service communications (e.g., security notices, important updates). Marketing communications require consent where required by law (see Privacy Policy).
22. Changes to the Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (e.g., in-app notice). Continued use after the effective date means you accept the updated Terms.
23. Governing Law and Jurisdiction
23.1. These Terms are governed by the laws of Georgia.
23.2. If you are an EU/UK consumer, you may benefit from mandatory consumer protection laws of your country of residence, and you may bring claims in your local courts where applicable.
